Terms of Service

Terms governing use of the Trustaige Identity Platform.

Effective Date: February 1, 2025

These Terms of Service (“Terms”) govern your use of the Trustaige Identity Platform and related services (“Services”) provided by Trustaige (“we”, “our”, “us”). By accessing or using our Services, you agree to be bound by these Terms.

1. Service Description

Trustaige provides an enterprise identity and access management platform built on WebAuthn/FIDO2, OpenID Connect (OIDC), and SAML 2.0 standards. The Services include passwordless authentication, single sign-on, user lifecycle management, and related identity services.

2. Account Registration

  • You must provide accurate, complete, and current information during registration
  • You are responsible for maintaining the security of your organization’s account and authenticator devices
  • You must promptly notify us of any unauthorized access to your account
  • One organization account may have multiple authorized users as managed by your organization’s administrators

3. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to the Services or related systems
  • Interfere with or disrupt the integrity or performance of the Services
  • Reverse engineer, decompile, or attempt to extract source code from the Services
  • Use the Services to store or transmit malicious code
  • Resell or redistribute the Services without our prior written consent

4. Service Tiers

Foundation

Includes hardware-attested identity verification, biometric binding, core application SSO, role-based access policies, and standard support.

Scale

Includes everything in Foundation, plus advanced authentication policies, SCIM user provisioning, custom application integrations, and priority support.

Premier

Includes everything in Scale, plus enhanced security configurations, dedicated deployment options, and a dedicated support team. Premier pricing is determined on a per-engagement basis.

5. Trial Period

Trial accounts are provided for evaluation purposes. During the trial period:

  • Access to Services may be limited
  • We reserve the right to terminate trial accounts at any time
  • No service level commitments apply during the trial period
  • Data created during the trial may be retained or deleted at our discretion upon trial expiration

6. Payment and Billing

  • Pricing is based on the number of active users per month in your organization
  • Payment terms are specified in your subscription agreement
  • Prices may change with 30 days’ written notice
  • Failure to pay may result in suspension or termination of Services

7. Data Ownership

  • Your data: You retain all rights to data you and your users provide to the Services. We do not claim ownership of your organization’s data.
  • Credentials: WebAuthn private keys are generated and stored on end-user devices. We store only the corresponding public keys necessary to verify authentication.
  • Our services: We retain all rights to the Services, including software, documentation, and intellectual property.

8. Service Availability

We strive to maintain high availability of the Services but do not guarantee uninterrupted access. We may temporarily suspend access for:

  • Scheduled maintenance (with reasonable advance notice)
  • Emergency security updates
  • Circumstances beyond our reasonable control

9. Security

We implement industry-standard security measures including:

  • Encryption in transit and at rest
  • Phishing-resistant authentication via WebAuthn/FIDO2
  • Session management with device tracking and revocation capabilities
  • Comprehensive audit logging
  • Content Security Policy and HSTS enforcement

You are responsible for managing your organization’s authentication policies, user access, and administrator credentials.

10. Limitation of Liability

To the maximum extent permitted by law, Trustaige shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services.

Our total liability for any claims arising from these Terms or use of the Services shall not exceed the amounts paid by you to Trustaige during the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Trustaige from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services or violation of these Terms.

12. Termination

Either party may terminate the subscription:

  • With 30 days’ written notice at the end of a billing period
  • Immediately upon material breach by the other party that remains uncured for 15 days after written notice

Upon termination, your access to the Services will cease and we will delete your organization’s data within 90 days, unless retention is required by law.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to your account administrator at least 30 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
